This note is the first of several updates to all of our webmasters regarding the new Justice Department regulations for 18 U.S.C. 2257 which will go into effect on June 23, 2005. As you know ARS has never managed the content or sites within its portfolio. Our current paysite operator, Storm Media, is doing everything it can to become 100% compliant. However, compliance with the new regulations will require some very important changes to be made within the ARS program. Many of those changes are set forth below. We will follow this with additional correspondences to our affiliates, together with further changes, if any, we feel necessary to insure that we are fully in compliance with the law under the new regulations.

*Free content: At this time ARS will discontinue
offering free content for promotion of any of it's
sites. If you are using free content for any of the
reality sites, you should remove it now. Though Storm
Media is in possession of the id's for this content we
are not going to be providing them to webmasters and
would ask that you remove any “explicit content”
advertising these sites. Explicit content includes actual
sexual conduct including all varieties of sexual intercourse,
vaginal, oral, anal, gay, straight, bestiality, masturbation
and sadistic or masochistic abuse. Also, any depictions
of the genitals would fall within this definition.


*Promo material: Storm Media will be going through the
promo database and removing all explicit banners, these
will be replaced in the coming weeks with non-explicit
banners that will not require documentation for you to
utilize to send traffic to the websites.

*Free Hosted Galleries: Storm Media is in the process
of updating the free hosted galleries so they contain
only 2557 compliant content. In addition once other
changes have been made they will begin an aggressive
system that will allow you to create your own
galleries picking out content from their content
database and then placed into the FHG system thus
requiring you to maintain no documentation on the new
galleries you create so long as you link to them in a
text based manner.

*NexGen FreeHost: Due to the significant liability issues
placed on Freehosting firms under the new provisions
of 2257, ARS will be discontinuing this service. All
material placed on the free host should be removed by
June 15th. At that point in time we will delete all
the content on the freehost and directories will be
replaced with a text link 404 page that includes links
to all the ARS sites with your webmaster id in them.

*Site Removal: As has been previously stated Horny
Traveler will be removed from the site portfolio, all
existing traffic will be directed to Reality Pass with
your webmaster id.

We appreciate your patience and understanding in these
matters. Even though our content has all been purchased
since January of this year, unfortunately due to these
new regulations, up to 20% of it will still not be in full
compliance with the law and we must and will remove it.

There are two signficant changes to the BYOT system that will occur in the next few weeks. First and foremost, any designs that you currently have online that we have had to remove content from will be placed offline. This will occur on June, 13th., At that time, you will be able to begin swapping out pictures with compliant pics. If a tour is not compliant by June 20th, Storm Media will temporarily take it offline. In addition, to date,
no movie tours or combo pic/movie tours are compliant with the new regulations because, the movie studios have provided zero documentation though we have repeatedly requested they do so. Storm Media is diligently working with new, 2257 compliant studios get replacement inventory online as soon as possible.

The second important change is to promo material. All promo material in the system that is explcit will have to be removed and redesigned. Storm Media is reviewing and approving around 500 sets of content a day that is currently showing up in the design area. When you are redesigning your tours and sites, make sure your banners are softcore with no visible genital shots or other explicit material.

Dear ATKCash Affiliates:

As many of you are aware, the recent changes to the 2257 laws have caused much of the online adult community to scramble for information and guidance. Several of our webmasters have approached us about our stance and course of action, and we appreciate everyone's patience awaiting our official announcement.

Fortunately for ATKINGDOM, our approved ATKCash affiliate content has ALWAYS been softcore in nature. Our TOS states in Section 9:

"The free areas of the submitted site must not contain sexual activity or hardcore material meant to promote ATKINGDOM. All such content must be restricted to the password-protected areas. You can not use ANY hardcore images to promote ATKINGDOM outside of age verified areas. ATKINGDOM defines hardcore as any type of actual insertion into the mouth, anus or vagina (by device, another person, or other parts of the model's own anatomy). Mouth to mouth kissing, licking, and touching of any part of their anatomy other than the places specified above is acceptable."

Our policy prohibiting hardcore promotional material will not change. In line with the provision that content portraying masturbation is considered hardcore, as of June 10th (our next scheduled release date of the nearly 1Gb of content we release monthly) there will be no images that could even remotely be considered masturbatory. We will be adjusting our Free Hosted Galleries, premade galleries, and banners to remove any hint of masturbation as defined by 2257.

If you are hosting any ATKINGDOM content (including banners) that is hardcore in nature, we respectfully ask that you remove this content immediately. While in itself, we would consider hardcore promotional materials from our site to be a violation of our TOS and subject to closure of your account, the new 2257 regulations mean the penalties for noncompliant US webmasters are MUCH worse than just having your account terminated.

Since our affiliate content will remain softcore, we WILL NOT BE RELEASING ANY MODEL IDs. We have the utmost respect for our performers' privacy and safety and will take no risks to jeopardize either. As you all know as of June 23, the U.S. government will enforce stronger regulations for publication of sexually explicit material on its territory. 1 - You will need to provide proof of identification that corresponds to your Braincash account. The proof need to be a valid legal government ID and will need to be send to us by fax or buy email. We may verify the information to make sure that you are who you claim to be.

2- You will be asked to sign a non-disclosure agreement. The main idea is that you will not have the right to transfer the ID to any 3th parties. The only people you can show them are the government in case of a 2257 verification.

3- If you are not a current webmaster of Braincash. You may be asked for references from other sponsors. We will not release the ID to someone who never did a sale in this business before.

4- You will need to provide us a valid phone number where to reach you. We will call you to double check everything and to give you your personal pin code to access the 2257 section inside the Marketing Tools of Braincash.

To ensure the protection and privacy of the personal ID cards of the models, we will be watermarking the Ids & release with your webmaster information. This mean that your name, address, Braincash account ID and other personal info will also be generated into the ID & release. We tough this way, webmasters would be less interested in spreading them all over the web and it would be easier to trace the source and make them liable if something happen.

Some people may say that we modify the images this way. I would say to them that you still have all the information to prove that the content is legal and that we still have the non watermarked version if they would be really required. The decison is up to you and if you don’t feel comfortable with this, just don’t use the content. This is the best balance we achieve in protecting the models and giving the 2257 information to webmasters. You'll found a sample of a watermarked ID just under.

Unless you've been hiding under a rock, you have probably heard all the talk about the new U.S.C. 2257 regulation changes which are supposed to take effect on Jun 23, 2005.

Under the new law, if it does go into effect, we would be required to give out confidential model information to all of our affiliates. This is not possible as it would violate our models rights and the contract we have with them.

Therefore, we are officially announcing that as of Jun 23, 2005, you will no longer have permission to use our hardcore FREE content in promotion of our program. We realize that this imposes a hardship on many of you and we apologize for this inconvience. There are attorneys who are trying to stop or alter this new law and if this occurs, we will make a new announcement regarding that as well. The actions we are taking will be just as much, or more, for your protection as ours.

Under the new law, YOU would be required to be a "Custodian Of Records" for your sites and this would place a huge responsibility on you and also place you in danger of violating a Federal Law. Unless you hear otherwise, please remove ALL hardcore promotional material of ours from your sites.

This includes genital photos, closeups of genitals, wide open spread shots, anal sex, simulated sex, penetration, oral sex of any kind, and so forth.

In light of the recent 2257 hoopla we know everyone is scrambling to do their best to prepare for the possilbe onslaught. The good news for you is that our DDGcash program and ALL ddgcash affiliated free content programs like DDGtools are 2257 compliant and you can utilize our DDGtools galleries and content with complete confidence.

As we're sure you are aware there is a new Federal statute (U.S.C 2257) which will be in affect as of June 23rd. This new statute requires all producers of adult material on the web (primary being us Digital Dreamgirls) and secondary (being you the webmaster affiliate using our free content) to have records of all content which is;

Sexually explicit conduct--which refers to inercourse, bestiality, masturbation, or sadistic abuse.

We have gone through all of our content on our DDGtools program – http://www.ddgtools.com and made sure that all the galleries there are in line with the current regulations. It has been our policy since the inception of our tools program to only include 'soft' images that would be immune to such regulations anyhow.

2257 Compliancy

We have been working with our Lawyer in order to organize ourselves to be 2257 compliant. It was also important to us that US webmasters and foreign webmasters had choices, and that everybody that wants to be, can be 2257 compliant. We have come to a concrete decision that we believe will serve everybody, and we are very happy to be able to announce it.

We will be providing webmasters with non sexually explicit free content. Anybody is welcome to use it. We understand that some people only want to advertise via softcore content, so this was part of our resolution. Non sexually explicit to us means no

A. Sexual intercourse, including genital-gential, oral-genital, or oral-anal
B. masturbation
C. sadistic or masochistic abuse; or
D. lascivious exhibition of the genitals or pubic area of any person


This content will be topless only and will be branded as usual. You will be able to find it within our webmaster section soon.

We will also be providing hardcore content as usual. Within the 2257 hardcore zip files we will provide the correct documentation, with the model addresses blacked out, you will have her full name, DOB and picture. We are ONLY using content that we have documentation for, we will be fully organized and fully compliant with the 2257 regulations. In case a webmaster does get questioned for 2257 compliance by the relevant authorities our documents will be fully accessible to you. We will also have a softcore downloads section, and a hardcore downloads section with no 2257 documentation for non US citizens.

Regarding banners, we have always and will continue to make non sexually explicit banners for our webmasters that prefer to advertise via softcore content. We have over 300 ads that are not sexually explicit including half page ads, full page ads, etc. For now our hardcore banners will remain, and you are welcome to use them at your OWN DISCRETION. Should you feel the need to change out your hardcore banners at this time you will find suitable softcore banners in our banner section.

Give us a bit to reorganize our free content section and possibly our banner section, over the next week or so we will be adding tons of free softcore content and adding the documentation into the zip files of hardcore content.

As a company that has always been concerned about its affiliates and whom has consistently take steps to protect them through the years we want to make you aware of several factors. The new 2257 legislation is something that will affect many people besides those now considered secondary producers. In an effort to comply with new legislation and protect the identities of our performers this is what we have decided to do for our company and those involved with us.

Effective June 23, 2005 we will no longer be providing content that can be deemed “sexually explicit”
to our affiliates for the purpose of creating galleries, web pages and other promotional materials.

By definition. 2257 is a record keeping/creating and maintaining law and can only affect those that are required to keep records. Softcore content in our attorney's opinion is not covered under any 2257 legislation to date. Affiliates publishing sponsor materials that do not depict actual sexual explicit sex do not need to keep records under the 2257 legislation.

Our webmasters TOS pages will be updated to explain in detail what this means to you and where you can get new content and promotional materials that will comply with new legislation. There are no exceptions to this no matter what country you live in. As of June 23, 2005 anyone caught promoting our sites after that date using hardcore content and not complying with the new 2257 legislation will have their account closed.

We are committed to making our webmasters as much money as possible while remaining responsible. We will be going though our affiliate area and providing an abundance of non sexually explicit images for our webmasters use in building galleries , web pages and other promotional materials. We will also be adding many, many more hosted galleries that display hardcore content since linking to these pages does not require you to hold records. More details on this to follow. We are also actively working on alternative compliant solutions to provide our webmasters with what they want in regards to promotional materials. It is our intention to provide you with as many tools as possible.

These changes are based on current legislation, if our attorneys or the FSC are able to fight the point that are unjust and get the laws changed or blocked we will then keep you up to date with future changes. We encourage all of you to donate to the FSC to help fight this and to contact a lawyer that specializes in 2257 or adult content law.

We are here to help you during this transition, please feel free to contact us with any question you may have about how this affect you as our affiliate. We will now concentrate on answering our Affiliates questions and will not be available to comment on this in a public forum. Ok, everyone seems to be waiting to see which sponsor will be first with their 2257 annoucement. I'd also like to wait and see what everyone else's plans are before announcing ours, but I want to give our webmasters as much time as possible to make required changes.

The 2257 law is here, and it is no joke. Under the best case, this law will be used only to give the people who exploit actual children exactly what they deserve: JAIL TIME.

The media and governments have lumped legitimate adult entertainment companies together with child pornographers for too long. This is our chance to show some real responsibility and SET OURSELVES APART.

However under the worst case, this could be the beginning of a real challenge to the adult internet as we know it. Honest and legitimate company owners could be jailed for simple record-keeping inadequacies. The law seems written in a way that no one will be able to comply with 100% accuracy.

I believe the 2257 law as written has several flaws that will not withstand a legal challenge. Most importantly, the safety and privacy of performers has been completely ignored. It is unconscionable to sacrifice the rights of performers the way this law demands. That is why Lightspeedcash has donated our financial support to the Free Speech Coalition, who plan on filing for an injunction against the 2257 law before the June 23 enforcement deadline. We all must support them and their objective, so donate what you can. Spread the word that there is a fighting chance.

The only prudent course of action for now is to follow the law as it is written and to error on the side of caution. I feel strongly enough about the privacy and safety of our models that I WILL NOT RELEASE THEIR IDS TO WEBMASTERS. There is a better solution for Lightspeedcash, our models, and our affiliates:

Effective June 23, 2005, Lightspeedcash will no longer authorize affiliate use of SEXUALLY EXPLICIT content to promote our sites.

We may be one of the fortunate companies, as 90% of our content is softcore/nonnude in nature already and our internal 2257 records are perfect. We recommend affiliates use text links and/or SOFTCORE thumbnail links to our HOSTED CONTENT wherever possible. Take advantage of our hosted galleries, hosted TGP, hosted bookmarks page, and our hosted Picture of the Day links. Hotlinking content or the use of IFRAMES will not be allowed. Simply link to us and let us worry about the documentation. This policy APPLIES TO EVERYONE, not just our US webmasters. I won't put our US webmasters at a disadvantage. Failure to comply with this new requirement will result in the termination of your Lightspeedcash affiliate status, and the forfeiture of any outstanding earnings. We simply can't and won't take no for an answer.

I also make a request to the TGP and MGP owners to allow existing galleries to be modified to comply with the new 2257 requirements. We are all in this together. No one wants to lose their traffic or their revenue, but without bending the rules about modifying existing galleries, you will put yourselves and your submitters at risk.

Lightspeedcash is 100% committed to this industry and to our webmasters. We will be available to answer any and all affiliate questions and concerns. I know this solution will not please everyone, and I apologize now if you are inconvenienced by our choices. We are all connected to each other, that is the biggest strength of this industry. Let's not turn in into our biggest weakness.

After much discussion we have decided to pull all non-compliant "Sexual
Explicit" content from the MP Webmaster area.

Now for the reasons,

We don't really have allot of "Sexual Explicit" so our decision is easy,
this will keep us, our affiliates and our partners safer then going the
hard-core route.

Most of the content we give out is for the solo model sites, which are
mostly soft core.

I see allot of talk of people split on this, the ones who really have no
hard-core content are saying they won't give ID's out, well good for them
that's an easy call, the large big programs that have been giving hard-core
out for years have no choice, if I was in their shoes I would be giving the
ID's out.

For us since we never went full hard-core we can pull back with some loses
and continue. With the new 2257 and all the political issues this seems like
the way to go for us.

So what does this mean for MP Webmasters?

The free content section will be updated with "Non Sexual Explicit" older
non-complaint content will need to be removed or replaced by June 23.

We will have the thumbs of the content back up so you can see what needs to be pulled or replaced.

All ads, banners etc are being looked at also and will be changed; this will
only affect 5% of our ads since most are soft core.

We will be adding more hosted, free site hosted and more free content to
make up for what we had to remove.

This does not affect the MP Hosted pages, these will have the proper 2257 linking code in the next few days.

Also if you have allot of pages made with our content, please send us an e-mail, or ICQ we have some options to help out, including buying licenses for you and supplying new fresh content.

I represent OC Cash Media. We received your inquiry concerning copies of records for secondary producers. I am very familiar with 18 U.S.C. § 2257 in my capacities as a First Amendment and criminal defense practitioner, the Chairman Emeritus of the First Amendment Lawyers Association and the Chair of the Board of the industry’s trade association, the Free Speech Coalition. I write this letter exclusively in my capacity as OC Cash Media’s attorney

Despite General Gonzalez’ efforts at reviving the concept of “secondary producers” in the most recent version of regulations in support of 18 U.S.C. § 2257, the concept is not supported by the statute itself. The only case addressing the issue, Sundance Assocs. Inc. v. Reno, 139 F.3d 804, 807 (10th Cir.1998), held that the “secondary producer” requirements of the regulations to be unconstitutional. We rely on that holding, and further decline to violate the privacy of the performing artists by disseminating private data when not required to do so by law.

The new 2257 regulations are causing a lot of concern and uncertainty in the industry so please take the time to read this email, as it will most probably affect you.

We are based in Australia as well as South Africa and the changes to the 2257 regulations do not affect us. However we are 2257 compliant and this decision was made last year already when the first wave of suggestions was issued by the DOJ.

FREE CONTENT

USA AFFILIATES Due to these updated 2257 regulations we will not be supplying model ID’s to any of our affiliates. All USA affiliates who need to abide with the changed 2257 regulations are on notice to remove any sexually explicit content of ours they may be using. Our terms and conditions will be changed to reflect this.

NON USA AFFILIATES If you are a non-USA affiliate and wish to continue using sexually explicit content then we have no problem with that and this will also be mentioned in our new terms and conditions.

UNFAIR ADVANTAGE? I know that this decision may be seen by some USA affiliates that we are disadvantaging them but this is not the case. It would be unfair of us to force non-USA affiliates to abide with USA laws since we ourselves are not legally bound by them.

If the European Union had issued these new regulations instead of the USA DOJ then it would be unfair to force USA affiliates to abide with the EU regulations.

The majority of our sites and content are Softcore in any case so there will be very few images that need to be removed.
